Terms & Conditions - SWITCH OFF COMPETITION

  1. SWITCH OFF was created by Laura Ryan and Jessica Gill, with publicity, administration, and website hosting of the competition being conducted by Synergy.
  2. The winner will be the school which shows the greatest percentage reduction in the rate of electricity consumption, measured in Units Per Day (Kilowatt hours) over the period of the competition, compared to a benchmark period on the same meter(s) at a similar time in 2009.
  3. Information on eligibility and prizes form part of these Terms and Conditions.
  4. Entry into the competition must be completed on-line www.switchoff.com.au by 8:00PM WST by Friday 2 July 2010. No late entries will be accepted. Entry into Switch Off must be completed by a teacher or Principal at the nominated school.
  5. The competition commences on Wednesday 21 July 2010 and finishes on Wednesday 20 September 2010.
  6. A maximum of four meters per school can be entered into the Switch Off competition.
  7. Eligibility in the SWITCH OFF competition is restricted to schools within the South West Interconnected System only which are Synergy customers.
  8. The Promoting school, attended by Laura Ryan, (La Salle College) is eligible to enter the competition, but is not eligible to claim a prize.
  9. Schools with solar PV systems already installed are allowed to enter, only if the solar PV system was installed before June 2009 and the energy usage of the solar system can be read. All schools with solar PV systems are to declare this information on the on-line registration form prior to the competition start date.
  10. Each entrant is only eligible for one prize.
  11. The total prize pool available is valued at AUD $14,790 RRP. , according to the table below. Note: RRP given below are an indicative pricing as of 1/5/2010 and subject to change.

  12. The Promoter is not responsible or liable for any change in the value of the prize.
  13. Prizes are not transferable, exchangeable or redeemable for cash. In the event that any prize is unavailable the Promoter and/or prize supplier reserves the right to negotiate a suitable alternative prize.
  14. Any taxes which may be payable by the winner as a consequence of a winner receiving the prize is the sole responsibility of the winner.
  15. 15. Successful nominations will be notified via email following registration at www.switchoff.com.au.
  16. Prizes will be awarded to the school on or before Friday 11 December 2010. A table of results will be published on the Synergy web site at www.switchoff.com.au. The results will be assessed by Synergy and approved by a judging panel, chaired by Synergy's Head of Corporate Affairs. The panel's decision will be final and not subject to challenge.
  17. The installation of the first prize will be negotiated between the school and Solar Shop Australia at a time which is mutually convenient.
  18. Entry into the competition is free.
  19. All entries are the property of Switch Off, Synergy and Solar Shop Australia.
  20. The Promoter may at any time disqualify an entrant or refuse entry to the competition if:
    1. The entrant fails to comply with these Terms and Conditions
    2. The entrant is engaged in practices which subvert or intend to subvert these Terms and Conditions;
    3. The Promoter determines that an entrant is tampering with the entry process or the operation of the competition.
  21. Switch Off and/or Synergy are not liable for, loss or damage whatsoever which is suffered or sustained, to persons or property (including but not limited to indirect or consequential loss), arising from or in any way related to the competition, or using, the prize.
  22. If for any reason the competition is not capable of being conducted as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, human error, technical malfunction or any other cases beyond the control of the Promoter which corrupt or affect the administration, fairness, integrity or proper conduct of the competition, the Promoter reserves the right in its sole discretion to disqualify any school involved in the tampering of the entry process, and to cancel, terminate, modify or suspend the competition
  23. Switch Off and/or Synergy are not liable or responsible for any problems or technical malfunction, including but not limited to, lost in postal services, wrong address given, or failure of any entry to be received by Switch Off or Synergy.
  24. Where requested, the winner must sign and return any liability release provided by the Switch Off and/or Synergy as a condition of the prize being awarded. If the winner fails to sign and return any such release, the winner forfeits the prize.
  25. All entrants irrevocably consent to the use of its name and suburb for use in any form of media whatsoever of my name, image, voice, statement or otherwise, before, during or after the competition whether for advertising, promotion or otherwise, without payment or compensation and agrees to participate in promotional activities and such other publicity as requested by the Promoter or Synergy or Solar Shop Australia without additional compensation (financial or otherwise) unless prohibited by law.
  26. By agreeing to these Terms and Conditions the entrant is giving Synergy the right to view their Synergy electricity account and all consumption records contained within, and publish their school's weekly energy consumption on the Switch Off website for the duration of the competition.
  27. Synergy reserves the right to conduct its own meter readings for each school participating in the Switch Off competition, and any such meter readings will be deemed to be the school's meter reading regardless of any other meter readings undertaken by participants.
  28. As part of nominations the winning school agrees to sign up for the National Solar Schools Program to receive first prize, if they are eligible to do so and if the Program is in operation. As part of nominating each school agrees for their information to be given to Solar Shop Australia for the purpose of purpose of marketing initiatives during the competition period.
  29. Terms of Use - SWITCH OFF COMPETITION MICROSITE

  30. Submissions may not infringe any third-party rights, including, but not limited to, copyright, trademark, publicity, or privacy rights. When entrants make a submission, they acknowledge that they have all necessary rights, including copyright in the material contained in their submission.
  31. Submissions must not be false, misleading, deceptive, fraudulent, libellous, defamatory, obscene, pornographic, harassing, abusive, threatening, racially offensive, offensively directed towards people based on their gender, sexual orientation or otherwise discriminatory or be otherwise objectionable. If there is any question as to what constitutes objectionable material under these Terms of Use, Synergy is the final arbiter of what does or does not constitute objectionable material.
  32. Submissions must not be intended to exploit any material for commercial purposes or advertise or solicit funds.
  33. Submissions must not use the Switch Off website to advocate or offer instructions as to illegal activities or to violate any applicable laws.
  34. Submissions must not be in violation of the guidelines set forth in these Terms of Use. Any such actions shall be a material breach of these Terms of Use. Synergy will remove any submissions that violate any provision of these Terms of Use and will cooperate fully with any law enforcement officials and/or agencies in the investigation of any violator or violators. In addition, Synergy may terminate the right to access the Switch Off website by any user who violates these Terms of Use immediately and without prior notice.
  35. Incomplete, inaudible, incomprehensible and illegible entries will be deemed invalid as determined by Synergy. This decision will be final and no correspondence entered into.
